Working on a Tourist Visa
- India doesn't offer a digital nomad or remote-work visa; the e-Tourist Visa (see the Visa & Immigration page for India) is issued for tourism, and doesn't authorize employment of any kind, including remote work for a foreign employer performed while you're physically in India.
- There's no dedicated legal pathway that specifically covers 'working remotely for a foreign company while visiting India' the way some other countries on this site now offer; you're operating in the same gray zone as unauthorized-but-quiet remote work in destinations without a nomad visa.
Tax Residency
- Under Section 6 of the Income Tax Act, you become a tax resident of India if you're present for 182 days or more in a financial year (April to March), or, under an alternate test, 60 days or more in that year combined with 365 days or more across the preceding four years.
- The 182-day threshold conveniently lines up with the FRRO registration trigger discussed on the Visa & Immigration page, so if you're tracking one, you're effectively tracking both.
- Once you're a tax resident, India generally taxes worldwide income, not just India-sourced income; non-residents are taxed only on India-sourced income.
The Gotcha
The complete absence of any digital-nomad or remote-work visa category is itself the gotcha: unlike Portugal, Spain, Indonesia, or the Philippines, there's no official route that specifically sanctions logging into a foreign job while visiting India on a tourist visa. Whatever you do here rests on quiet, unauthorized practice, not a legal framework built for it.
